Luka Dončić has asked a Los Angeles judge to throw out child support and attorney fee paperwork his ex-fiancée filed in California. His argument is simple and blunt. The children live in Slovenia, not California, and a Slovenian court is already handling custody and support issues.

Why he wants the California filing dismissed

In court documents filed Friday, Dončić and his lawyer, Laura Wasser, say neither he nor his daughters are California residents. They argue the California filing is improper because the family lives in Slovenia and Dončić already started a legal proceeding there in February that addresses custody and child support.

Residence and recent history

According to the papers, Dončić asked his ex to move to California with their children. She declined and moved back to Slovenia last May. Dončić has said the distance contributed to his decision to end the engagement.

Who the kids are and who pays

Dončić says he is covering the living expenses for his daughters, 2-year-old Gabriela and 4-month-old Olivia. The documents note his three-year, $165 million contract and say his payments already meet the children’s needs.

Forum shopping allegation and legal request

Dončić’s team accuses his ex of forum shopping, saying the California filing appears aimed at taking advantage of higher child support awards there. He is asking the court to dismiss the California case as procedurally defective and legally improper because jurisdiction belongs to Slovenia.

What Dončić said publicly

When he announced the breakup, Dončić told ESPN, "Everything I do is for my daughters' happiness and I will always fight to be with them and give them the best life I can."

The immediate next step is for the L.A. judge to consider Dončić’s motion to dismiss. If the judge agrees, the California filing will be removed and the Slovenian case will remain the primary legal venue for custody and support matters.
